Once you have decided to hire a law firm to handle your claim, there is a process your attorney will follow in proceeding with your lawsuit.
You are named the plaintiff, and the opposing company is named the defendant.
First a claim will be made and submitted to the courthouse, where the defendant will be notified and allowed 30 days to submit their response. Usually the response comes back as denying or accepting a claim. Unless there is a prior settlement, the answer is usually denying the claim.
You will then be required to answer in writing and under oath a set of written questions. Your lawyer will be able to assist you in the process. Afterwards you will be required to answer questions orally, and also under oath, by the defendants lawyers. This process is also known as the deposition. Once this is done, the trial date will be set.
Trial dates range in time from several months to a couple of years. The wait sometimes is related to the advanced nature of the plaintiffs illness.
